What is ITR-3? Who can file it and how to file it online — FilingSetu blog guide

One form for business, profession and trading income, plus everything else you earned.

ITR-3 is the income tax return form for individuals and HUFs who have income from a business or profession. That includes freelancers, consultants, shop owners and traders with intraday or F&O income. You file ITR-3 when you cannot use, or choose not to use, ITR-4. It also takes your salary, rent, capital gains and interest, so all your income goes on one form.

What is ITR-3?

ITR-3 is one of the seven income tax return forms for AY 2026-27 (the financial year 2025-26). The form itself says it is "for individuals and HUFs having income from profits and gains of business or profession".

In simple words, if any part of your income is from running a business or practising a profession, and you are not using ITR-4, ITR-3 is your form. ITR-1 and ITR-2 have no place for business or profession income, so they are not an option.

Who can file ITR-3?

You can file ITR-3 if you are an individual or an HUF and you have income from a business or profession, and you are not eligible for ITR-1, ITR-2 or ITR-4.

Your situationForm
Freelancer or consultant who keeps full books of accountITR-3
Business owner who keeps full books of accountITR-3
Intraday or F&O traderITR-3
Salaried person with freelance, business or trading income on the sideITR-3 (or ITR-4, if the side income is presumptive and you are eligible)
Business or profession income on a presumptive basis, but you cannot use ITR-4 (for example, total income above ₹50 lakh, short-term capital gains, foreign assets, or you are a company director)ITR-3
Non-resident with business or profession income in IndiaITR-3 (ITR-4 is for residents only)
HUF with business incomeITR-3 (or ITR-4, if eligible)

ITR-4 is optional. The department's ITR-4 FAQ says "Form ITR-4 (SUGAM) is not mandatory". So even if you qualify for ITR-4, you may file ITR-3 instead.

Who cannot file ITR-3

  • Firms, LLPs and companies. ITR-3 is for individuals and HUFs only. Firms (including LLPs), AOPs and BOIs file ITR-5, and companies file ITR-6.
  • People with no business or profession income. If your income is only salary, pension, house property, capital gains and interest, ITR-3 is not your form. You file ITR-1 or ITR-2. Our guide on which ITR form to file helps you pick.

Can a salaried person file ITR-3?

Yes, if you also have income from a business or profession. ITR-3 has a salary schedule (Schedule S), so your salary and your business income go on the same form.

If you have only salary, with no business, freelance or trading income, you do not need ITR-3. You file ITR-1 or ITR-2.

ITR-3 for intraday, F&O and share trading

The ITR-3 trading account has separate lines for trading income:

Line in the trading account (Part A-TA)What goes there
12aTurnover from intraday trading
12bIncome from intraday trading, carried to the profit and loss account
12cTurnover from futures and options (F&O) trading
12dIncome from F&O trading, carried to the profit and loss account

How the tax law sees each kind of trade:

  • Intraday share trading (you buy and sell the same day, with no delivery) is a speculative business. The Income-tax Act treats a share deal settled without actual delivery as a speculative transaction.
  • F&O on a recognised stock exchange is business income, but it is not speculative. The law excludes eligible derivative trades in shares on a recognised stock exchange from the meaning of speculative transaction.

Because both are business income, they cannot go in ITR-1 or ITR-2. A salaried person with intraday or F&O income files ITR-3.

What about shares you bought and held? If you report share or mutual fund sales as capital gains and you have no business income, ITR-2 is the form. ITR-3 also has capital gains schedules (Schedule CG and Schedule 112A), so a trader reports any capital gains on the same form.

If you file late, there is one more cost to keep in mind. A loss (other than a house property loss) cannot be carried forward to later years if the return is filed after the due date.

ITR-3 or ITR-4?

Both forms are for business or profession income. ITR-4 is a short form only for presumptive income under section 44AD, 44ADA or 44AE, for residents with total income up to ₹50 lakh. ITR-3 takes any business or profession income, with no income limit, and also has a place for presumptive income. For the full side-by-side table, see ITR-3 vs ITR-4. To check if presumptive income suits you, read presumptive taxation under section 44AD and 44ADA.

Is ITR-3 available for AY 2026-27?

Yes. The Excel utility for ITR-3 for AY 2026-27 was first released on 18 June 2026, and you can also file ITR-3 online on the e-filing portal. The utility gets updated during the year, so download the latest version from the portal's Downloads page each time.
